Complaint Process

The Human Rights Commissioner’s Office (HRCO) deals primarily with all Code-based issues and complaints under the Human Rights: Code-Related Harassment and Discrimination Policy #240.

The HRCO does not normally deal with non-Code related issues, except to provide informal support as needed. General harassment or discrimination concerns, specific to Board employees, that do not pertain to a human rights ground are typically addressed through the Violence Prevention and Intervention and Non-Code Workplace Related Harassment - Employees Policy #250.0.  Allegations of behavior by a staff member or member of school community that violates professional standards, statutory law, or Board polices and expectations are dealt with through the Standards of Conduct Policy #242​.

Upon receiving a complaint, the HRCO will:

  • Listen to the concerns of any member of the Board community seeking advice or information regarding human rights matters
  • Advise a Board community member who is a complainant or respondent in a human rights matter
  • Inform the member of other relevant Board policies and procedures
  • Provide information on the informal resolution processes and formal resolution complaint processes
  • If necessary, make a referral to support services
  • Facilitate or initiate informal resolution processes as agreed to by the complainant and/or respondent
  • Refer formal complaints to the appropriate dispute resolution mechanism

In addressing a human rights complaint, the HRCO maintains an impartial approach. Our team strives to explore the differing perspectives and understand all sides of a complaint toward uncovering what transpired. Any complainant, who seeks resolution of a complaint through informal or formal complaint procedures, must be prepared to be identified to the respondent.  

Human Rights Commissioner's Office Reporting Form (Discrimination/Harassment/Bullying)

The HRCO Report Form is to be used to report behaviour that may contravene Human Rights: Code-Related Harassment and Discrimination Policy #240.

Please note that the Reporting Form is used by the HRCO for our general understanding of the key issue(s) pertaining to your matter. It is also necessary for our internal tracking purposes. It is not a "Complaint Form".

It must be made clear that a completed Reporting Form will automatically transmit directly to the HRCO. At no time is the Reporting Form shared with any other office at the Board. Strict confidentiality and privacy is guaranteed at all times and consistent with the arm's-length position of the HRCO.

We welcome any concerns or questions regarding privacy and/or confidentiality. You may also call our office at 905.773.2046 ext. 255. In addition, after hours, you may leave a confidential voice message with a call back number. Our goal is to return all emails and voice messages within 24 hour of receipt.

Please note that submitting this form does not constitute commencement of a formal complaint or that any specific action(s) will necessarily be taken by the HRCO at YRDSB. In most cases, you will be offered a confidential consultation with the Human Rights Commissioner in order to determine next steps. The HRCO will endeavour to respond to this report within three working days. The information that you submit will be received by the HRCO via confidential email.

All reports are maintained as per the practices of the HRCO, including confidentiality and file retention and will not be shared with any other department or unit within YRDSB.
